Abstract

This study which is titled)The Legislative Frameworks for Local Units in Kurdistan Region(, is an important legal topic in the field of administration governance and is regarded one of the most important topics in the field of the law, democracy and good governance. This study is regarded as a general research related to administrative decentralization, shedding lights on its relationship to democratic governance, good governance, human development and political participation in public office. It is an attempt to demonstrate the administrative decentralization in Iraqi Kurdistan region in terms of the related constitutional and legal provisions. The Kurdistan Regional Government has tended recently to the adoption of administrative decentralization system, especially after the formation of the two independent administrations in Rapareen and Garmyan, establishment of Halabja governorate, enactment of the Law on the administration of governorates, provinces and districts in Kurdistan Region No. (3) for the year 2009, and other actions, attempts and the steps taken by the provincial authorities to establish such a system and promote it. However, the legislative frameworks have not integrated and have some shortcomings which imposed to be reconsidered and revised in order to be more suitable for the new developments that Kurdistan Region witnesses. The importance of this study lies in particular in the fact that it sheds lights on the administrative decentralization in Iraqi Kurdistan Region showing the problems and obstacles on one hand, and how these obstacles can be removed on the other hand, all these
in the light of the Law on the administration of governorates, provinces and districts in Kurdistan Region No. (3) for the year 2009.
