Abstract
Trade name is deemed to be one of the important instruments of introducing companies since the customer can easily differentiate the company that they want to deal with. Therefore, these names are usually infringed by other companies due to the popularity and reputation of these trade-names. The law protects trade names if they have been registered at the trade names registrar. The most important tool of trade names protection is to remove the names which have been registered illegally. This can be done by issuing a decision from the registrar of the trade names or form the courts. This decision will have several
legal consequences the most important one is that the company will temporarily have no name and because of that it cannot execute any legal action. At the end of this article, we have come up with several outcomes and two drafts of laws have been proposed for the legislator for amending the commercial law, the bylaw of the trade names and the trade register.
