This research examines the legal framework for the presence of the United Nations in Iraq, particularly the United Nations Assistance Mission for Iraq (UNAMI), which was established under Security Council resolutions after 2003, as the legal basis regulating the role of the United Nations in supporting political and security stability and respecting state sovereignty. The research problem lies in the extent to which the tasks of the United Nations in Iraq are consistent with the principle of national sovereignty, and the limits of its legal mandate in political, humanitarian and development affairs. The research aims to explain the legal nature of the United Nations presence in Iraq, analyze its roles in supporting the political process, protecting human rights, and providing humanitarian assistance, while assessing the effects of this presence on the Iraqi legal and political system. The research adopted the descriptive analytical approach, through analyzing Security Council resolutions, relevant international documents, and studying the practical practices of the United Nations in Iraq.

    The legal analysis concludes that the existence of the United Nations is based on clear international legitimacy, and constitutes a tool for technical and advisory support rather than interference in internal affairs, despite the accompanying legal and political challenges. The most important findings are that the United Nations’ role has contributed to strengthening electoral processes, supporting human rights, and mitigating the humanitarian effects of conflicts, while the need remains to regulate this role within the limits of Iraqi sovereignty. The research recommends strengthening legal and institutional coordination between the Iraqi government and the United Nations, and establishing clearer frameworks for the mission's tasks in accordance with the Iraqi constitution and international law. It also highlights the legal implications of this presence in reinforcing international commitment to protecting human rights and supporting state-building, while emphasizing the principles of partnership and respect for national sovereignty.
