Abstract
This research, titled "The Sovereignty of Law Reality in the Kurdistan Region of Iraq in Light of John Rawls ' Theory of Justice," examines the critical role of the sovereignty of law in fostering societal progress and its direct impact on development across various sectors. The sovereignty of law is instrumental in achieving equality, safeguarding rights, and ensuring justice. This analytical study is grounded in the theory of justice developed by John Rawls (1921–2002), one of the most prominent legal and political philosophers of the twentieth century. Rawls' theory emphasizes neutrality and consistency in the application of laws.
The primary objectives of the study are to analyze the state of the sovereignty of law in the Kurdistan Region through the lens of Rawls' theoretical framework, underscore the significance of legal compliance, and elucidate the fundamental principles of the sovereignty of law. The findings of the study indicate that the rule of law in the Kurdistan Region faces significant challenges, as its foundational principles are not sufficiently safeguarded. This observation is consistent with John Rawls’s theory of justice, which underscores the principles of equality, freedom, and human rights as essential components for achieving justice. Moreover, the study revealed that certain legislative frameworks in the Kurdistan Region lack comprehensiveness and fail to fully ensure the protection of citizens' rights. As a result, these laws are frequently subject to amendments and are not implemented in a manner that guarantees fairness and equality across all segments of society.
