Abstract
This research paper, titled (Linguistic Fundamental Rules through the Book of Mughni Al-Muhtaj by Al-Sherbini, deals with topics of command and prohibition as a model). In it, the researcher mentioned the linguistic fundamental rules contained in Al-Mughni’s book by Al-Sherbini. These rules are Arabic in form and subject, and in text and spirit, which scholars of fundamentals have arrived at as a result of extrapolation. Arabic methods, the connotations of words on rulings, as well as how to derive legal rulings and jurisprudential branches based on fundamental linguistic rules, in order to return particulars to universals, and link the fundamentals to the branches. The research aimed to clarify the role of the linguistic fundamentalist rules - topics of command and prohibition - in constructing the branches, and to show the extent to which Al-Sherbini, may God have mercy on him, applied the linguistic fundamentalist rules in grading the branches of jurisprudence on them, because knowing the science of grading the branches according to the principles makes the student acquainted with the secrets of the Sharia, the understandings of the rulings, and the approaches to the issues. Jurisprudence.The researcher first began by defining the fundamentalist rule independently and as a title and science for a specific science. After his linguistic and terminological definition, the researcher concluded a brief definition of the fundamentalist rule as (a comprehensive issue through which one arrives at the conclusion of legal rulings). Then the researcher explained the difference between the fundamentalist rule and the principles of jurisprudence. As well as the jurisprudential rule, then he touched on the types of fundamentalist rules. The researcher devoted the second section to presenting the linguistic fundamentalist rules related to issues of command and prohibition, while mentioning the jurisprudential applications that El-Sherbini referred to based on these rules, after completing the presentation of each rule, in order to show the reader, the jurisprudential rulings that were built on the linguistic fundamentalist rules. The researcher reached several points and results that he mentioned in the conclusion.
